boy if i were a republicailure i'd be pretty pissed that a) the tastycrats found such a clean candidate and b) the GOP can't do much more than phone in an opposition. they just seem all tuckered out!

I think it's more about knowing you can't really stop Kagan from being appointed, so it's just a token opposition so when she votes against something the GOP wants or vice versa, they can point back at it and say "see, we tried!".

But without making too big of a stink to draw too much ire in the present.

Hell, if ANY Court has been an "Activist Court" it's been the conservative-dominated court of the last few years. What have they done? Remember that ruling on eminent domain? How about the one that gives corporations the ability to give unlimited money to political candidates? I'm just scratching the surface here.

It's utterly insane. I can't wait for Alito & Thomas to keel over dead so that hopefully someone with a BRAIN can replace them.

I think Kagan is going to get confirmed, certainly. My actually worry is that she won't be liberal ENOUGH, and the court will move even FURTHER to the right, which quite literally terrifies me.

which brings up a good point.

in this country how is it acceptable these days for someone to hold an office until they die without constant re-election or affirmation that they populous thinks they're doing a good job? And even with re-election, definitely need term limits. I mean even the POTUS has that. How can a court that makes decisions that impact decades if not longer have similar stipulations?

really boggles my mind.

Congress really needs term limits. Two 6-year terms for senators should be more than enough, and a few terms for congressman.

I think career politicians are harmful/manipulative to our system of government.

100% agree.

My only issue regarding term limits is they can't be so short that a good agenda never gets a chance to get "done". 12 years IMO is PLENTY. Then GTFO and stop making a business out of your public service "JOB".

The eminent domain case decision was 5 to 4, with O'Connor, Rehnquist, Scalia, and Thomas dissenting. That's the ruling that allowed corporations to essentially trump your property rights.

Also, term limits for Congress needs to be a constitutional amendment, and it's only made it to an actual vote once in our history, in 1995.
