As it turns out, Ayala has a litigious history. She has filed claims against several corporations, including a former employer and General Motors, though it is unclear from court records whether she received any money. She said she got $30,000 from El Pollo Loco after her 13-year-old daughter got sick at one of the chain’s Las Vegas-area restaurants. El Pollo Loco officials say she did not get a dime.

The San Jose Police fraud unit joined Las Vegas police in the search of her home there, and officers have questioned her relatives. A family friend, Ken Bono, 24, said the warrant indicated police were looking for a cooler, a blue bag and “any family documents about anybody dead.”

Ayala’s sister Mary, who lives in San Jose but missed the fateful meal at Wendy’s, has been outspoken in defense of her sister.

The police “wanted to know if I ever asked her, even jokingly, ‘Hey, did you do it?”’ Mary Ayala said. “I said, ‘No, my sister wouldn’t do that.”’ She added: “It’s just a mess right now. Things are out of hand.”

If police do obtain evidence that Ayala planted the finger, she could face charges of fraud, extortion or making false statements, legal experts said.

Back at the Wendy’s where the chili was served, customers seem convinced the tale of the finger was a scam.

“There’s too much in this country today with people trying to get things by conning them out of it. Wendy’s has been good for years,” said longtime customer 81-year-old Ralph Woodman. “How the hell would you get a finger into the pot without seeing it in there when you’re stirring it? It had to be some sort of screwball ruse.”

I just saw your post, Damm, but have been meaning to mention something on this topic.

As I said in the original post concerning this topic, I had a hard time believing so many could possibly completely miss said finger and serve it to a customer. It's just unthinkable.

I'm glad this cunt is getting arrested. I fucking *hate* people like her, just like that stupid chicken head chicken nugget bitch. Anything for a free buck instead of working for it. She gives America a bad name, and should be ashamed of herself for what she did to so many people. All the people she forced to get laid off.. it isn't like the people that work for Wendy's are financially stable, but at least they're working.

I had a feeling this would surface when she withdrew all charges because "it would be too emotionally trying."

Shame on her.

Man says found skin on sandwich

DAYTON, Ohio - A man is suing a fast-food restaurant operator for more than $50,000, claiming he found a slice of skin on his chicken sandwich.

David Scheiding filed the lawsuit in Montgomery County Common Pleas Court on April 1 after rejecting a settlement offer from GZK Inc., his lawyer said. GZK owns the Arby's restaurant in Tipp City where he bought the sandwich.

Scheiding said he realized something wasn't right when he bit into the sandwich on June 18 and found a piece of flesh about three-fourths of an inch long.

"It looked like I was seeing fingerprints on it," he said. "I got sick and went to the bathroom."

Miami County health investigators talked to the restaurant manager, who had a bandage on his right thumb and wore a latex glove, according to a health district report. The manager said he sliced skin from the thumb while shredding lettuce, and sanitized the area but didn't throw away the bin of lettuce, the report said. Scheiding's sandwich contained lettuce.

"Why wasn't the food searched, and why wasn't it thrown away?" said Scheiding's lawyer, Hank Hyde.

Christine Koeller, vice president of marketing and communications with GZK, said what happened was unintentional.

"(The manager) did destroy product that was in and around the slicer immediately, and did everything that he thought was appropriate to do," Koeller said.
