Any single Moms in Texas?

So the neighbor and his wife decided tehy needed some time apart so she went to D.C. to visit her Dad leaving him all alone. She sent her son to his Dad's and took their girl with her.

So she is gone for about 2 days, and Michael comes over to my house angry with me. I asked him what the matter was, and he told me that her cousin had called and told him everything. Apparantly, Machele told me and her cousin the details of what happened both times she was unfaithful to her husband. I kept my mouth shut becuase all I had was what she told me and her story changed at least a dozen times. I explained this to Michael and after he told me everything he knew, I confirmed what he was saying. I feel like I betrayed my friends., I was stuck in the middle by the wife and I have known Michael for more than 20 years, but I told him I didn't know the whole truth either and I didnt want to be in the middle. He said he understands.

She is an alcholic and addicted to prescription pain medication, both of which I have witnessed. (she was drinking and driving one night and knocked down the neighbors fence) Now he is asking me to go to court because he plans on filing for custody of their daughter. Not only does Machele have those problems, but she also can not hold a job. Every job she has ever had, she has been fired for something to do with sexual harassment. So without Michaels money, she can not support herself or her daughter. She is already having the 6 year old girl call from DC every night telling her Dad that she needs to stay with mommy, and she can be heard in the background feeding the little girl things to say. I told him we would cross that bridge when we came to it.

Again, I don't want to be in the middle, but I do know that she is a horrible mother, and the girl would be better off with her Dad. I feel bad for her son, because he is truly shit out of luck.


This is my question. I know in Ohio this is the law, but in Texas is it true that whomever files for custody first will get custody until the divorce is final?

Some states will put the children in custody of a relative in the mean time. It's usually a tossup and it always TRIES to be in the best interest of the children.

I have NEVER heard of this. Can you quote any case instances?

Oh, and no. In Texas, to my knowledge as of 2001, this is not true.
It doesn't matter who filed first - it makes no difference in Texas (unless they have changed this in the past 8 years, which is doubtful since it's been this way for decades).
The children typically stay in the custody of the mother unless the children are in danger, then, if the father is shown to be reasonably fit, they will stay with him. There is also the possibility that if the father is not deemed fit that the children will be become temporary wards of the state, and then the closest relatives will be requested to take custody until further investigation by the CPA, usually starting with the mother's side first, then if no one is willing, then the father's side.
My ex s-i-l worked for child protective services in Austin for years, and it should be noted that unless he can prove either physical abuse of the children or prominent drug abuse by the mom, despite her worthlessness, she will most likely still keep custody of the kids. If he wants to battle for custody, not only will he have to prove beyond the shadow of a doubt that she is a horrible mother, but he has to be an absolutely pristine dad. The law favors the mom.

I would highly advise that he go and seek professional counsel as I am outdated, not having lived there or been in contact with anyone from there for a long time. He might even be able to get it free.
