Since he is still governor, it's within his rights to pick a replacement.

of course it's within his rights, that doesn't mean it will pass and that he isn't completely nucking futs. i feel bad for the guy he chose, who seems to be a totally valid candidate, he will probably get screwed through this whole thing and not get the appointment.
