Cops can't just "search your car" . . .

It seems to be a slow day on NT.
http://www.msnbc.msn.com/id/30328976/I can appreciate both sides of this story but I agree with the majority in this case. Especially with the increased numbers of folks living in their cars, it's damn near the same as a house for some folks.

I would have to say I agree with the outcome on this as well. While a warrantless search on cars may put more guilty people behind bars, so would removing the warrant restrictions from just about everything else. In the end, you have no rights against having anything searched at any time on a whim.

the cops were abusing it... they would arrest folks for something lame and then search the car for no good reason other than they could

What about strip searching little kids in public schools by school officials? That apparently is A OK.

I didn't see the outcome of that from the supreme court, did they decide and I overlooked it?
I can't think they will actually side with the school. I thought one of them even said something to the effect "what's next, body cavity searches". My biggest issue is they didn't call the parents. The child had no legal representation / protection, not from the courts but from adults whom are authority figures, who they're taught not to disobey, this never should have taken place without the parents being present.

That's likely true with your children, but if this is referring to the deal a while back where the girl was baldly lying and making fun of the teachers and officers about the presence of a cell phone, I'd say her parents must have forgotten that lesson. If the police are present and a search is conducted within the confines of the law I don't take issue with it however, to the best of my knowledge even the previously mentioned situation wouldn't legally warrant a body search. Breaking School rules is not necessarily the same thing as breaking the law. What the school should have done was get a hold of the girls parents, and I think the court would rule in the girls favor if it were brought before it as a search and seizure case.

I think the case he's referring to there is the one currently before the supreme court about a girl who was strip searched on some pretty flimsy suspicion that she had, *gasp*, Ibuprophin in her possession.

Wouldn't be a problem if parents did their fucking jobs and stopped letting schools run wild with gestapo bullshit just because they're "too busy" to care.

I don't think there's been a decision yet, last I read there was an opening hearing, and speculation is that SCOTUS may overturn the 9th circuit verdict (coming down in favor of the school) because the judges voiced concerns about situations that might involve illegal drugs.
By the way, is there anyone here with children that would have no issue with their child being strip searched by their school administration?

I can certainly tell you that if one of my children was strip searched by the school administration without having first contacted me and my being present on school ground would be in for a legal battle. I may not be able to win, but I am sure I can find an attorney who would love to take this as far as possible and make the school officials lives a living nightmare.

I'm really concerned about what the outcome of this ruling will be if the 9th circuit ruling is overturned. A legal case "taking it as far as possible" might not go very far. I don't have kids, but I do have nieces and nephews and frankly the thought of any of them getting stripped searched by a school for any reason without their parents and/or police present for something that his not a violation of a law makes my blood boil.

in my mind the girl who ratted the other girl is probably a vindictive bitch who wanted to get the strip searched girl in trouble.. dont know if that happened but thats what could of happened.
what is great is if the girl wanted an abortion the school would of been ok with it but woe unto the child if she has an advil

Saying the school might be okay with providing a morning after pill might be more applicable Nusk. One thing I haven't seen yet in any article is anyone in favor of this mentioning that it might be necessary to strip search a student for something other then medication or drugs, most notably a fire arm, although I guess for the most part that a pat down would suffice, although frankly a pat down might be more invasive than a strip search to be 100 percent sure.

I would have a major problem with this and if it were to happen to one of my boys without my wife or I being there, I'd do anything I could to sue there asses and I am not a "sue" happy type person to say the least.
I think you'd be safe to assume there are no good parents IMO that would be OK with this.

Because of her involvement with C4L, and the Motorhome Diaries crew, I keep up with what she's doing and last week she was on her way to meet up with them when they were stopped in Jones County, Mississippi by police officers. They were arrested, pepper-sprayed and their RV was searched/impounded, all without EVER being read their rights. Very interesting story.
