it's starting to become debateable

now that the babyboomers are all retiring, there's way more people pulling from the system rather than contributing

the theory is still there, but it's getting in tough shape

I claim married and 3 dependents. I pay very little in taxes during the year, and I still get a nice chunk at tax time.

I am divorced, Gyps, but when I put Head of Household on my forms, they told me the only way to do that was to use married. I'm not complaining. My checks are roughly $1000 and they take out $17 bucks or so for taxes, that doesnt affect teh FICA-MED or the FICA-OASDI Which is roughly about $80. After my insurance, I still bring home over $800. Again, Im not complaining

I would be concerned for the long run claiming married as a divorcee, though.. wouldn't you think? I mean for auditing and whatnot. I don't really understand how they can force you to claim married just because you're head of the household

I dunno, I just do as the white collars in HR tell me to. Let them audit me, I claim Head of Household on my taxes, and turn them in. Lots of married people claim Single on their paystubs. *Shrug*

They pay me back every penny I pay them, and then some. I don't think I am breaking any laws here.

No shit, I paid in $19,457.03 just in federal withholding and only getting back around $7000 between state and federal.

Sigh, let me break it down easily for you. I file head of household, period, I have ever since I got a divorce. I do qualify under tax law to file head of household.

From IRS.gov

Head of Household
You may be able to file as head of household if you meet all the following requirements.

You are unmarried or “considered unmarried” on the last day of the year.

You paid more than half the cost of keeping up a home for the year.

A “qualifying person” lived with you in the home for more than half the year (except for temporary absences, such as school). However, if the “qualifying person” is your dependent parent, he or she does not have to live with you. See Special rule for parent, later, under Qualifying Person.




If you qualify to file as head of household, your tax rate usually will be lower than the rates for single or married filing separately. You will also receive a higher standard deduction than if you file as single or married filing separately.

How to file. If you file as head of household, you can use either Form 1040A or Form 1040. Indicate your choice of this filing status by checking the box on line 4 of either form. Use the Head of a household column of the Tax Table or Section D of the Tax Computation Worksheet to figure your tax.

Considered Unmarried
To qualify for head of household status, you must be either unmarried or considered unmarried on the last day of the year. You are considered unmarried on the last day of the tax year if you meet all the following tests.

You file a separate return (defined, earlier, under Joint Return After Separate Returns).

You paid more than half the cost of keeping up your home for the tax year.

Your spouse did not live in your home during the last 6 months of the tax year. Your spouse is considered to live in your home even if he or she is temporarily absent due to special circumstances. See Temporary absences, later.

Your home was the main home of your child, stepchild, or eligible foster child for more than half the year. (See Home of qualifying person, later, for rules applying to a child's birth, death, or temporary absence during the year.)

You must be able to claim an exemption for the child. However, you meet this test if you cannot claim the exemption only because the noncustodial parent can claim the child using the rules described later in Children of divorced or separated parents under Qualifying Child or in Support Test for Children of Divorced or Separated Parents under Qualifying Relative. The general rules for claiming an exemption for a dependent are explained later under Exemptions for Dependents.

My i-9 is marked head of household as well, but for whatever reason they mark it as married, claiming 3. Why? I don't know, maybe to offset something somewhere. They hold out more taxes on a married person than they do on a person filing head of household. So, I am paying in more than what I should be.

Hate to break it to you, but I will take the advice of my HR department over someone on the internet anyday.

Not I-9, Im sorry W-4. I just talked to my parents accountant Debbie. She said it doesn't matter what they withhold during the year, it is what you actually file on your taxes. Then she said that I get it all back anyway, so it isn't an issue.

So, to explain it logically. They take out more than what they should during the year, so I get it all back at tax time no matter what my w-4 status shows. What you file on your W4 just tells the company how much to withhold out of your paystubs.

Again, once you go through tax school, and learn the tax laws and get your degree in accounting, then you can fake concern. Until then I'll listen to the lady my parents pay ever year to do their accounting.

But I do appreciate your concern Gyps, and I did look it up. I do not understand why Tacks gives a fuck though, and why he has to argue every single move I make with me. I just don't get it.
