One of hte girls who works there is all upset because she has to call in this weekend. Its an odd reason, and I will go into it in a moment, but we work on a point system, 10 points and you are out, she has 2. Both were for forgetting to punch in or out.

Now, the reason she is calling in is because she has been sick to the point where she has to call for someone to cover her register so she can go and vomit. I asked her if she was pregnant, and she told me it wasnt possible, so I told her to go to doctor. Turns out she was pregnant, and she has to terminate.She is RH- or + I forget which one, and she has had one child, which she almost died giving birth to, their second child had to be induced at 6 months ad was still born, and now the doctor is telling her she is too high a risk to carry this third child to term. The doctor prescribed her a pill and told her she has to take it on Saturday, everything will naturally clean out of her system. She talked to the HR manager who was very supportive and said he understood and told her to take all the time she needed. The other manager involved went off (after she left and I was there) about how this is an elective procedure and she should have thought about that before she got knocked up and we are already short staffed and she is calling in on a weekend.

Now she is afraid she will loose her job. Any thoughts?

She talked to the HR manager who was very supportive and said he understood and told her to take all the time she needed. She should take Saturday off.

Then she should go back to HR on Monday, and let them know she's being harassed for a valid female medical issue, and that it has caused severe distress and pain to her.

Then she should consider contacting an attorney, and seeing what lawsuit options are available to her.

If the manager literally said to her that she should've thought about that before she got knocked up, like Lyion said - she should definitely call an attorney. That's absolutely ridiculous, and even the biggest dickhead of managers are trained to never say shit like that to their employees. That's unacceptable - not because she's a woman, but because that's very unprofessional and never acceptable to say to an employee under any circumstance.

To my knowledge, if there is documented discrimination or persecution, even after termination, there is cause for concern.

This may be a state law, but I am sure I read this recently.

Oh I see that now - even still, though.. saying it around other employees especially about a private matter that it's a privilege for her to share with HR at all and not a right is never okay - that's her personal business, and not something to scrutinize her for and certainly not something to fire her for
