The right wing attack machine had better be careful going after this one. Her judicial chops and qualifications are some of the best in the country at this point, and she had broad republican support in the past, so if they rail on her now they're going to appear more hypocritical than they already do. Not to mention just how happy the appointment has made a lot of the hispanic community in the country, and if they go tooth and nail in opposition despite her qualifications, they're going to be angering a huge voting demographic. The California GOP still hasn't even come close to recovering the damage they did themselves with Prop 187.

Honestly, especially since even if he appointed a frothingly radical liberal to the spot it wouldn't change the court demographics, plus given all the negatives to making this a huge fight for what would be blatantly strictly partisan politics, I don't think the GOP fights this one much. I think they save their all-out warfare for any pick that Obama gets that might replace one of the current conservative judges with someone more liberal. There's just way too much to lose on this one for absolutely negligible gain; they'd be utterly idiotic to even threaten to go the filibuster route. Then again, given the current state of the GOP, I may be giving them too much credit for intelligence and political savvy. I mean, the head of their party, Rush, has already demanded they try and shoot down her nomination, so....

I don't know about the GOP not fighting, there was some idiot on NPR this morning talking filibuster(sp). Then another one talking last night about how "she does not have the intellect" ...

Then another person said, why is it thomas, sotomayer, <minority> are always "lacking intellect" but when it is a white male, hey, no problems. Sort of called the guy a racist but in a round about PC way.

They do until Minnesota gets its shit together and finally puts Al Franken into the office he won what, more than 6 months ago now?

You need 60 votes to shut down a filibuster, and even if all the democrats (including Specter) and the 2 independents that vote with them were to vote to stop the filibuster, they've only got 59 votes until Franken is seated finally.

The guy who made that comment is the William Nelson Cromwell Professor of Law at Yale Law School. He didn't draw any comparison to a white male. He just said it's interesting how the GOP said the same thing about Thurgood Marshall and Clarence Thomas. If it's true it's true.

You're right, the reporter is whom I meant commented regarding the "racist" bit but he never said "racist" just some statement of why intellect never appears as an issue for the other (white) guys (i.e. the rest of the bench)

This would be the official stance of the right:

http://michellemalkin.com/2009/05/27/th ... s-contest/

as I've seen most of the talking points in various other conservative pieces.

Since when did securing a Supreme Court seat become a high hurdles contest? The White House and Democrats have turned Second Circuit judge Sonia Sotomayor’s nomination into a personal Olympics event. Pay no attention to her jurisprudence. She grew up in a Bronx public housing project. She was diagnosed with childhood diabetes at 8. Her father died a year later.

And oh, by the way, did you hear that she was poor?

It’s a “compelling personal story,” as we heard 20,956 times on Tuesday. Sotomayor’s a “real” person. Why, she even read Nancy Drew as a young girl, President Obama told us. She’s “faced down barriers, overcome the odds and lived out the American dream that brought her parents here so long ago,” Obama said.

If Sotomayor were auditioning to be Oprah Winfrey’s fill-in host, I’d understand the over-the-top hyping of her life narrative. But isn’t anybody on Sotomayor’s side the least bit embarrassed by all this liberal condescension?...

This has little to do with Sotomayer or her being good for the job and has everything to do with two opposing media outlets having a slap fest with each other. They might as well be arguing about why my dog humps my cat.

Liberal media: Considering the right has deemed the "perfect family" to be one husband, one wife, two children, one dog and one cat, what else is the dog to do but show his affection for the cat considering the lack of a second dog.

Conservative media: That's completely off base and the liberal media should be ashamed of such an accusation. We are in now way advocating a single dog household and the fact of the matter is the dog did what it did because the family advocates same sex marriage, which like dogs and cats copulating is AN ABOMINATION!

The media doesn't really matter. Dems watch MSNBC and CNN. Conservatives watch Fox. Smart people watch a bit of everything and glean the truth.

The GOP will oppose her because her rulings lean to the left. As they should. It's the same as with Chief Justice Roberts, whom it was silly to vote against given his credentials, yet many did.

As for me, this was a good choice in my mind. She's Catholic. She sides with the law more than not. She isn't a hardcore Ruth Bader Ginsberg type of judge, but more in the mold of Kennedy. She's pretty much a liberal version of Alito. The Court retains it's 4-1-4 fairness setup. I don't see any of the conservative judges leaving anytime soon, so it should keep the status quo for a while.

p.s. Your dog humps your cat? I hope you don't have a Lab or Great Dane.

Yeah it mostly happens when we're paying too much attention to the cat. Either he get's humped or he get's dragged along the floor like a dust mop by the back of his neck. He's totally cool with it too, he probably just likes the attention.

You can see Fred the cat here freaking out on a sock filled with catnip and Lola makes an appearence 30 seconds in because Fred is getting too much attention:

A lot of it sounds bad at first, but turns out to not be bad at all if you actually play the entire context.

Also, the whole judging based on ethnicity thing is just about word for word with what Alito said when he was getting confirmed. Oh, and the whole policy bit? Scalia said exactly the same thing too, and in any case, it was a speech advising new law students where they should apply to work as a law clerk.

So yeah, tons of it is pretty ridiculous. I also like how they're trying to attack her intelligence too. Uh, last I checked, stupid people didn't graduate 2nd in their class at Princeton, nor did they do so well at Yale legal school as to get to edit the Yale Law Review journal.

Anyway, it's pretty much a foregone conclusion she's going to get confirmed. Just need to see how much damage the GOP is going to inflict on itself before it happens...
