An appellate court on Thursday ordered a new trial for a Florida woman who was sentenced to 20 years in prison for firing a gun to scare off her allegedly abusive husband, ruling that a jury was improperly instructed on self-defense.

Marissa Alexander's case will be retried because the jury was wrongly told that -- for her to claim self-defense -- she needed to prove beyond a reasonable doubt that her husband was about to seriously harm her, the appellate court said.

Rather, the appellate court pointed out, the prosecution had the burden to prove that Alexander herself was guilty of aggravated assault.

"Because the jury instructions on self-defense were fundamental error, we reverse" the conviction, a three-judge appellate panel said.

A jury convicted Alexander, 31, of aggravated assault in March after just 12 minutes of deliberation.

She displayed that when she shot at her husband after having left the "imminent danger" (hint: there was none, because you can't walk away from "imminent danger") The very definition of imminent danger goes against "I can walk away, retrieve my weapon from my car, and then reenter the situation."

Also, a "warning shot" indoors is incredibly dangerous to the public, her children in the home, etc. It's reckless and stupid. She deserves the sentencing and everyone in her life is safer for it. She's demonstrated herself to be a violent woman on more than one occasion already. She shot a "warning shot" at the man's head. It wasn't in the air, or more importantly at the ground where it would have been more plausible and a fuck of a lot safer.

While she was out on bail, awaiting trial on her aggravated assault charges, Alexander was arrested for domestic battery against Gray.

She is only saying it's a warning shot to get around the fact she shot at a man, missed, and now doesn't want to be painted the violent psychopath that she is. What she didn't realize is that a "warning shot" even if that's what she did, and it wasn't, is illegal in Florida and the classes and training she took to obtain her license to carry would have covered that in great detail.

Also, your assumption that she is making this story up without a shred of evidence doesn't lend much credibility to your objectivity. Why do you think she simply missed him? I don't think I've ever uttered these words and I'm not sure I ever will again, but I'm actually quite proud to call myself a Duval County resident today. Our justice system actually got it right.. twice.. in one day.. in one city.. in Florida.. a place that hasn't gotten a single damn thing right in years. I'm amazed.
